The French magazine "Closer" published those topless sunbathing photos of KATE MIDDLETON on Friday. But after Kate and her husband PRINCE WILLIAM filed a lawsuit against them, they took them off their website. Still, an Italian magazine owned by the same company is supposedly planning to run 200 more of the pics TODAY.

They were taken while Will and Kate were swimming in their pool during a recent vacation in France.

A source says, quote, "They were stuck for 45 minutes, and it became very hot in there, but Mila and everyone else remained calm. There were fire trucks outside, and firefighters helped them get out."
