MEMPHIS, Tenn. (FOX13) -

A decision on the constitutionality of Municipal schools could come as early as today.  Judge Samuel Mays may rule on the fate of public schooling in Shelby County.

Friday was the last mediation session before it was decided that it would be pointless to continue.  The Suburban Representatives said they threw out several ideas but all were struck down by the County Commission Representatives.  According to Bartlett Mayor Keith McDonald, the suburbs want autonomy for their schools, and the commission was unwilling to budge.

Judge Mays is the mediator in the discussions, but McDonald says he did not show his hand.  "We're just really really anxious to hear what the judge has to say, very hopeful he'll see that out proof was adequate.  He'd be an awfully good poker player.  He didn't give any tells."

If he rules municipal schools are municipal.  Judge Mays will hear the case on whether the creation of municipal schools re-segregates Shelby County Schools next year.
