PURVIS, Miss. (AP) - A 2011 Hattiesburg homicide suspect is now under indictment in Lamar County for kidnapping and sexual assault.

Thirty-4-year-old Howard James Payton is charged with murder in the Sept. 26, 2011, shooting death of 33-year-old Marco Harris.

The Hattiesburg American reports (http://hatne.ws/13fACaf ) Payton faces one count of kidnapping and four sexual battery charges following a Feb. 27, 2009 incident.

Lamar County Sheriff Danny Rigel said the charges stem from the same incident with one victim.

Rigel said a University of Southern Mississippi student was walking to her car at an apartment complex when she was kidnapped and taken to a secluded area where she was sexually assaulted.

It was unclear whether Payton has an attorney on the new charges.
