"By all reports, the facts of the accident are not in question," said Thomas Greer. The civil attorney is representing Mackala Ross, the teen that died the Aug. 26 two-car crash with Beard, and her father, Michael Ross, who was injured.
"The city of Memphis is a governmental entity meaning there are caps on how much we can collect for the family," Greer said. "No one person in this wreck can collect more than $300,000 in total. The total amount we can collect is $700,000 (according to Tennessee State Law)."
Greer believes his client is entitled to the money.
"Picture this. Mr. Ross was doing everything right, following all the rules," he said. "He gets hurt by someone. He has $1 million in medical bills. The most he can collect is from the responsible party is $300,000. It's not fair."
Since October 2012 more than 200 Memphis police officers have been involved in traffic accidents. In 2011, 434 officers were involved in accidents.
"If he was hit by a private citizen, a private company, they would be able to be fully compensated," Greer said. "Cities in our state are protected."
